Chapter 12: A Mother's Vow
When it was Clara’s turn to take the stand, she didn't defend herself against the kidnapping charges. She spoke only of Toby.
""I know what I did was illegal under the law,"" Clara said, staring directly at the judge and jury. ""I took a child that was not legally mine. I broke the rules, and I am prepared to accept whatever punishment the court decides.""
She turned her gaze toward Richard and Victoria.
""But a house is not a home, and money is not love,"" Clara continued, her voice rich with raw emotion. ""I saw a child being abandoned by the people who were supposed to protect him. I couldn't leave him to suffer. If loving a child and fighting for his life makes me a criminal, then I am guilty.""
The defense rested its case.
The jury deliberated for less than three hours—an extraordinarily short time for a high-profile felony case. When they returned to the courtroom, the atmosphere was tense.
""On the charge of grand kidnapping, how do you find?"" the judge asked the jury foreman.
The foreman stood up. ""In light of extreme necessity and defense of a minor, we find the defendant, Clara Mercer, Not Guilty.""

The courtroom erupted into cheers. Spectators stood up, clapping. Richard and Victoria rushed out through a side door to avoid the swarm of flashing cameras, their reputation and public standing thoroughly shattered.
However, the legal battle was only half-won. While Clara was free from prison, she still had no legal right to Toby. The court temporarily placed Toby in state foster care while custody proceedings were arranged.
